ZONING BOARD OF ADJUSTMENT

October 22, 2019

 

 

CALL TO ORDER

Vice Chairman Cotton called the meeting to order at 5:30PM.

ROLL CALL

PRESENT MEMBERS: Anderson, Cotton, Hardin, Karar, Smith, Watkins

PRESENT ALTERNATE: None

PRESENT COUNCIL LIAISON: Hilliard

ABSENT MEMBER: McDonald, Pinkerton ABSENT ALTERNATE: Sanders ABSENT COUNCIL LIAISON: None

ADMINISTRATIVE STAFF PRESENT

Glenna Batchelor, Director of Planning and Development Erik Smith, Assistant Director/Planning Project Manager

ABSENCE

Mr. Smith, seconded by Mr. Watkins, approved absences of Mr. McDonald, Mr. Pinkerton and Mr. Sanders. Motion passed 6-0-0.

APPROVAL OF MINUTES

Mr. Watkins, seconded by Mr. Smith, made the motion for approval of the October 8, 2019 meeting minutes as written. Motion passed 6-0-0.

MEETING FORMAT

Vice Chairman Cotton went over the meeting format. Applicants were sworn in.

VICE CHAIRMAN COTTON OPENED THE ZONING BOARD OF ADJUSTMENT

ZBA-021-19

Application of Daren Hudson for a special exception for a mother-in-law dwelling/garage apartment in the “SF-2” Single Family Residential District in accordance with Zoning Ordinance O-2002-032-15, Section 9 and 35.H.10, on Lot 8, Block 20 of the Meadow Oaks Addition-Haltom, locally known as 5708 Briarcliff Road.

Staff presented the items.

The legal notice regarding the public hearing was published in the October 6, 2019 Fort Worth Star Telegram.

Written notice of the variance request was mailed to thirteen (13) property owners within 200' of the site on October 9, 2019. Staff received four (4) in favor or without objection, none (0) opposed, and none (0) returned to sender.

Vice Chairman Cotton opened the meeting for questions of City Staff.

Mrs. Hardin asked if what they were looking at was permitting this project.

Ms. Batchelor explained this is a legal nonconforming use. This was built prior to current ordinance. In 1998 a new ordinance was put in place that required special exceptions. This ordinance placed this structure in this position. This would bring up the building to what is required to current code.

Mr. Smith asked if this was being done because he wants to make this right and based on a compliant.

Ms. Batchelor said that was correct.

Mrs. Hardin asked if this was changing zoning. Ms. Batchelor said that it wasn’t.

Vice Chairman Cotton asked the applicant to make a presentation.

Daren Hudson, 5708 Briarcliff Road, said he was contacted by Code Officer Christian Warren about a complaint. Mr. Hudson said he invited Mr. Warren in to investigate the complaint. Mr. Hudson stated he bought the property in 1998 and the work by previous owner was already done with accessory building built in 1993 and house constructed in 1995. Later, Mr. Hudson contacted Ms. Batchelor to inquire about the procedure to make accessory living structure compliant instead of nonconforming. Mr. Hudson offered pictures to be presented to the Board but they did not deem necessary.

Vice Chairman Cotton opened the meeting to questions for the applicant.

Mrs. Hardin asked if the structure was to code.

Ms. Batchelor said since building permits were issued in 1993 for accessory building, it would have to be assumed it was constructed to code at the time.

Mrs. Hardin asked if square footage of both structures in listed on Tarrant Appraisal District.

Mr. Hudson responded in the positive.

Vice Chairman Cotton opened the Public Hearing. (Open 5:43PM)

ACTION BY THE BOARD

Mr. Smith, seconded by Mr. Watkins, motioned to approve the application of Daren Hudson for a special exception for a mother-in-law dwelling/garage apartment in the “SF-2” Single Family Residential District in accordance with Zoning Ordinance O-2002- 032-15, Section 9 and 35.H.10, on Lot 8, Block 20 of the Meadow Oaks Addition- Haltom, locally known as 5708 Briarcliff Road.

Mrs. Hardin called the roll:

Motion passed unanimously, 6-0-0.

MISCELLANEOUS

Ms. Batchelor advised there would not be a meeting November 12th.

There being no further business, Vice Chairman Cotton adjourned the meeting at 5:47PM.
