ZONING BOARD OF ADJUSTMENT

August 27, 2019

 

CALL TO ORDER

Chairman Pinkerton called the meeting to order at 5:40PM.

ROLL CALL

PRESENT MEMBERS: Anderson, Hardin, Karar, Ora, Pinkerton, Smith, Watkins

PRESENT ALTERNATE: None

PRESENT COUNCIL LIAISON: Hilliard

ABSENT MEMBER: Cotton ABSENT ALTERNATE: Sanders ABSENT COUNCIL LIAISON: None

ADMINISTRATIVE STAFF PRESENT

Glenna Batchelor, Director of Planning and Development Erik Smith, Assistant Director/Planning Project Manager

ABSENCE

Mr. Watkins, seconded by Mr. Karar, approved absences of Mr. Cotton and Mr. Sanders. Motion passed 7-0-0.

APPROVAL OF MINUTES

Mr. Pinkerton, seconded by Mr. Watkins, made the motion for approval of the August 13, 2019 meeting minutes as written. Motion passed 7-0-0.

MEETING FORMAT

Chairman Pinkerton went over the meeting format. Applicants were sworn in. SWEARING IN OF ALL PARTICIPANTS THAT WILL GIVE TESTIMONY CHAIRMAN PINKERTON OPENED THE ZONING BOARD OF ADJUSTMENT

ZBA-018-19

Application from Humberto Trejo for a variance to zoning ordinance O-2002-032-15, Section 29.B.5. to increase the total floor area of the accessory building on one lot to exceed 30 percent of the floor area of the main building on the lot, Section 29.B.7. An accessory building that exceeds 200 square feet must meet the masonry requirement of the primary structure., and Section 31.I. General parking surfaces to allow for a nonpaved vehicle maneuvering area on Lot 18, Block 31 of the Meadow Oaks Addition - Haltom, locally known as 3229 Jane Lane. Staff presented the items.

The legal notice regarding the public hearing was published in the August 10, 2019 Fort Worth Star Telegram.

Written notice of the variance request was mailed to fifteen (15) property owners within 200' of the site on August 16, 2019. Staff received three (3) in favor or without objection, none (0) opposed, and none (0) returned to sender.

Chairman Pinkerton opened the meeting for questions of City Staff.

Mr. Watkins asked if the building will be used for a business. Ms. Batchelor said that would be a question for the applicant.

Chairman Pinkerton asked the applicant to make a presentation.

Mr. Humberto Trejo, 3229 Jane Lane, Haltom City, Texas, 76117, advised that he built the garage for parking his trucks. He has already submitted engineer letters for the building and foundation. Will be removing tank from corner of back yard.

Chairman Pinkerton opened the meeting to questions for the applicant.

Mr. Watkins asked Mr. Trejo if this building would be used for commercial purposes. Mr. Trejo said that it would not be used for commercial business.

Chairman Pinkerton opened the Public Hearing. (Open 5:53PM)

Mr. Guadalupe Rios, 3228 Jane Lane, Haltom City, Texas, 76117, advised that he does not have a problem with the building.

ACTION BY THE BOARD

Mr. Karar, seconded by Mr. Smith, motioned to approve the application of Humberto Trejo for a variance to zoning ordinance O-2002-032-15, Section 29.B.5. to increase the total floor area of the accessory building on one lot to exceed 30 percent of the floor area of the main building on the lot, Section 29.B.7. An accessory building that exceeds 200 square feet must meet the masonry requirement of the primary structure, and Section 31.I. Motion failed by a vote of 3 - Ayes and 4 - Nays. Further discussion by Board.

Mrs. Hardin, seconded by Ms. Ora, motioned to approve the application of Humberto Trejo for a variance to zoning ordinance O-2002-032-15, Section 29.B.5. to increase the total floor area of the accessory building on one lot to exceed 30 percent of the floor area of the main building on the lot, Section 29.B.7. ZBA-019-19

Application from Eneas Posadas for a variance for a reduction in the fence setback for a corner lot that does not back up to an interior lot in accordance with Zoning Ordinance O-2002-032-15, Section 33. E. 1. e., in the “SF-2” Single Family Residential district on Lot 8, Block 89 of the Browning Heights East Subdivision, locally known as 5329 McQuade Street.

Staff presented the items.

Ms. Batchelor mentioned the visibility obstruction of tree at southeast corner of front yard. Also if six foot (6') wooden privacy fence is installed on property line at Revere you could not see traffic coming down Revere from the north.

Ms. Batchelor pointed out that the existing chain link fence along Revere is on the right- of-way at 8'5", not the property line of 9'6".

Julissa Posadas, 300 North Booth Calloway, Hurst, Texas, 76053, said she is the daughter of Eneas Posadas. He went in to work late due to the weather this morning and she is here representing him and will relay the information to him.

Chairman Pinkerton opened the meeting to questions for the applicant.

Discussion regarding visibility from stop sign at McQuade to see oncoming traffic from the north.

Mrs. Hardin, seconded by Mr. Pinkerton, made a motion to approve the application of Eneas Posadas for a variance for a reduction in the fence setback for a corner lot that

does not back up to an interior lot in accordance with Zoning Ordinance O-2002-032-15, Section 33. E. 1. e., in the “SF-2” Single Family Residential district on Lot 8, Block 89 of the Browning Heights East Subdivision, locally known as 5329 McQuade Street with the stipulations that the six foot (6') wooden privacy fence would be installed from the northeast corner of house to the southeast corner of detached garage and from the northeast corner of detached garage to property line at Revere, also the existing chain line fencing along Revere be removed.
