MINUTES ZONING BOARD OF ADJUSTMENT

March 26, 2019

CALL TO ORDER

Chairman Pinkerton called the meeting to order at 5:30PM.

ROLL CALL PRESENT MEMBERS: Anderson, Cotton, Elliott-Roach, Hardin, Karar, Pinkerton, Smith, Springfield PRESENT ALTERNATE: None PRESENT COUNCIL LIAISON: Watkins ABSENT MEMBER: None ABSENT ALTERNATE: Sanders ABSENT COUNCIL LIAISON: None ADMINISTRATIVE STAFF PRESENT

ABSENCE

Mr. Springfield, seconded by Mr. Smith, approved absences of Mr. Sanders. Motion passed 8-0-0.

APPROVAL OF MINUTES

Mr. Smith, seconded by Mr. Springfield, made the motion for approval of the February 26, 2019 meeting minutes as written. Motion passed 8-0-0.

MEETING FORMAT

Chairman Pinkerton went over the meeting format. Applicants were sworn in. SWEARING IN OF ALL PARTICIPANTS THAT WILL GIVE TESTIMONY CHAIRMAN PINKERTON OPENED THE ZONING BOARD OF ADJUSTMENT

ZBA-006-19

Application of Jimmy Glen Enos for a variance to allow for a storage container in accordance with Zoning Ordinance O-2002-032-15, Section 29.F.1, Non-Residential Temporary and Portable Type Accessory Buildings in the “C-5” Commercial District of the Joel Walker Survey, Abstract 1654, Tracts 14B & 14G, locally known as 4533 East Belknap Street.

Staff presented the items.

The legal notice regarding the public hearing was published in the February 24, 2019

Fort Worth Star Telegram.

Written notice of the variance request was mailed to ten (10) property owners within 200' of the site on February 27, 2019. Staff received three (3) in favor or without objection, none (0) opposed, and none (0) returned to sender.

Mr. Smith informed the Board the storage container is meant for temporary purposes. The applicant is requesting the storage container for six (6) months while they get the property platted and building plans approved for a permanent structure to replace the temporary storage container. Mr. Smith informed the Board staff has already met with the applicant's contractor to go over platting requirements but staff has yet to receive a plat to process. Mr. Smith stated the code case was initiated 10-18-2018 but owner stated it had been there since 07-2018. Variance paperwork was submitted 02-08- 2019.

Chairman Pinkerton opened the meeting for questions of City Staff.

No questions for staff.

Chairman Pinkerton asked the applicant to make a presentation.

Glen Enos, 4904 Pebble Court, said staff pretty much summed it up. They need this for storage while they get a permanent structure built.

Chairman Pinkerton opened the meeting to questions for the applicant.

Mrs. Hardin asked if they felt they could get this built within six (6) months which included platting and construction.

Mr. Enos said he felt they could get this done. Mr. Enos said he understood this would have to go away after that time if they were not able to get this work done.

ACTION BY THE BOARD

Mrs. Hardin, seconded by Mr. Smith, made a motion to approve the application of

Jimmy Glen Enos for a variance to allow for a storage container in accordance with Zoning Ordinance O-2002-032-15, Section 29.F.1, Non-Residential Temporary and Portable Type Accessory Buildings in the “C-5” Commercial District of the Joel Walker Survey, Abstract 1654, Tracts 14B & 14G, locally known as 4533 East Belknap Street for a period of six (6) months from the date of the hearing.

Mrs. Elliott-Roach called the roll:

Motion passed by a vote of 7-0-0. Mr. Springfield had recused himself from this case.

ZBA-007-19

Application of Jaime Torres for a special exception for a front yard carport in accordance with Zoning Ordinance O-2002-032-15, Section 35. H., in the “SF-2” Single Family district on Lot 2B, Block 5 of the Eastcliff Addition, locally known as 3705 Cheryl Street.

Staff presented the items.

The legal notice regarding the public hearing was published in the March 9, 2019 Fort Worth Star Telegram.

Written notice of the variance request was mailed to twenty six (26) property owners within 200' of the site on March 13, 2019. Staff received one (1) in favor or without objection, none (0) opposed, and one (1) returned to sender.

Ms. Batchelor provided a staff report. Advised that code case was initiated 09-28-2018, building permit submitted 02-01-2019 and special exception submitted 02-22-2019.

Chairman Pinkerton opened the meeting for questions of City Staff.

Mrs. Elliott-Roach asked if OSB with corrugated material is approved by Staff.

Ms. Batchelor said we will need plans and there has been no engineer stamp for this carport yet. Staff will need stamped plans before permits are issued.

Chairman Pinkerton asked the applicant to make a presentation.

Jaime Torres, 3705 Cheryl, did not further explain the carport.

Chairman Pinkerton opened the meeting to questions for the applicant.

Mr. Pinkerton asked why they did not get the permit.

Mr. Torres, translating through his daughter (Cynthia Torres), said he did not know he needed one.

Mr. Smith said to make sure they permit for work in the future.

Mr. Smith said he understood the setback.

Mrs. Hardin said they’ve approved a carport at 3708 didn’t they?

Ms. Batchelor said they did but they have brick boxing around the posts. Mrs. Hardin asked if this meets code.

Ms. Batchelor said the building official will need to look at the structural integrity. Most engineers may not sign off on this. The Board can add requirements to the request.

Mr. Smith asked if they approved this if the building department would review for code compliance.

Ms. Batchelor said they would.

Mr. Cotton said he was not sure he wanted structures like this all over town. Mrs. Hardin said if this met code would this type of structure be fine.

Ms. Batchelor said if they could find an engineer to draw plans and stamp them that is what we look for.

Mrs. Elliott-Roach asked if they could wait till they saw framing and engineered plans.

Ms. Batchelor said they could table it to get framing detail but they will need an engineer stamp for permit regardless.

Mrs. Hardin asked if they could continue this until then or if they would need to pay to come back to the Board.

Ms. Batchelor said they could table it or if a vote is taken on some thing and denied they would have to pay $300 to come back before the Board a year later with the request.

Mrs. Hardin asked if they could give some time to get the plans. Ms. Batchelor said they could.

Mr. Karar asked if the City allowed detached carports. Ms. Batchelor said they did.

Mr. Cotton asked if they come back with details and engineer stamp we would look at this or could they word this right to allow it.

Chairman Pinkerton reopened the Public Hearing. (Open 6:10PM)

Chairman Pinkerton asked if they understood what was being asked. If they wanted to put the money and time into this.

Mr. Torres said if they wanted it tore down that is fine.

Mr. Pinkerton said they could motion to have you come back with the correct plans you could or it would be one year if it is denied before they can come back.

Mr. Torres said it was likely this would come down.

Chairman Pinkerton said maybe but you’d have to get plans either way. Mr. Torres said if it’s denied is it a hard year.

Chairman Pinkerton said that is in the zoning ordinance.

Mr. Cotton asked if they could grant a stipulation that we grant a setback that would allow this without coming back.

Ms. Batchelor said there is no wording for that.

Mr. Karar asked if they could approve with a condition this is tore down if they could get engineered plans and a new one built.

Ms. Batchelor said they could do that.

Chairman Pinkerton closed the Public Hearing. (Close 6:20PM) ACTION BY THE BOARD

Mr. Karar, seconded by Mrs. Hardin, made a motion to approve the application of Jaime

Torres for a special exception for a front yard carport in accordance with Zoning Ordinance O-2002-032-15, Section 35. H., in the “SF-2” Single Family district on Lot 2B, Block 5 of the Eastcliff Addition, locally known as 3705 Cheryl Street with the provision they demolish the existing carport within thirty (30) days and within ninety (90) days submit new plans for permit and be finalized by September 30th, 2019.
