MINUTES

ZONING BOARD OF ADJUSTMENT

CALL TO ORDER

Chairman Pinkerton called the meeting to order at 5:40PM.

ROLL CALL

PRESENT MEMBERS: Anderson, Cotton, Elliott-Roach, Hardin, Karar, Pinkerton, Smith, Springfield

PRESENT ALTERNATE: None

PRESENT COUNCIL LIAISON: None

ABSENT MEMBER: None

ABSENT ALTERNATE: Sanders

ABSENT COUNCIL LIAISON: Watkins

ADMINISTRATIVE STAFF PRESENT

Glenna Batchelor, Director of Planning and Development Erik Smith, Assistant Director/Planning Project Manager

CHAIRMAN PINKERTON OPENED THE ZONING BOARD OF ADJUSTMENT ABSENCE

Mr. Smith, seconded by Mr. Springfield, approved absence of Mr. Sanders. Motion passed 8-0-0.

APPROVAL OF MINUTES

Mrs. Elliott-Roach, seconded by Mr. Springfield, made the motion for approval of the November 27, 2018 meeting minutes as written. Motion passed 8-0-0.

MEETING FORMAT

Chairman Pinkerton went over the meeting format.

SWEARING IN OF ALL PARTICIPANTS THAT WILL GIVE TESTIMONY

ZBA-038-18 Continuation of the application of Alonso Noris for a Special Exception for a front yard carport in in the “SF-2” Single Family District in accordance with Zoning Ordinance O- 2002-032-15, Section 35. H on Lot 21, Block, 9 of the Tri-Country Est 1st Fil Addition, locally known as 5729 Marlene Drive.

Staff presented the items.

The legal notice regarding the public hearing was published in the November 9, 2018 Fort Worth Star Telegram.

Written notice of the variance request was mailed to thirty-five (35) property owners within 200' of the site on November 14, 2018. Staff received two (2) in favor or without objection, one (1) opposed, and four (4) returned to sender.

Ms. Batchelor informed the Board that a structural engineer had revised and stamped the drawings to depict the carport that is actually constructed at the property.

Chairman Pinkerton opened the meeting for questions of City Staff.

Mrs. Elliott-Roach asked if they got the brace they needed. Ms. Batchelor said they modified the engineers stamp.

Chairman Pinkerton asked the applicant to make a presentation.

Maria Sanchez spoke for Mr. Noris. Owner obtained required drawing and engineer stamp as required from previous public hearing.

Chairman Pinkerton opened the meeting to questions for the applicant. Chairman Pinkerton opened the Public Hearing. (Open 5:48 PM)

No one to speak for or against.

Chairman Pinkerton closed the Public Hearing. (Close 5:48 PM) FURTHER DISCUSSION OF THE BOARD

Chairman Pinkerton said applicant has provided the criteria previously requested. Mr. Smith stated that the Engineer assumes liability by placing stamp on drawing.

ACTION BY THE BOARD

Mr. Karar, seconded by Mr. Springfield, made a motion to approve the application of Alonso Noris for a Special Exception for a front yard carport in in the “SF-2” Single Family District in accordance with Zoning Ordinance O-2002-032-15, Section 35. H on Lot 21, Block, 9 of the Tri-Country Est 1st Fil Addition, locally known as 5729 Marlene Drive.

STAFF UPDATE
