PLANNING & ZONING COMMISSION

May 28, 2019

 

 

CALL TO ORDER Acting Chair Chapman called the meeting to order at 7:15PM

DETERMINATION OF QUORUM

PRESENT MEMBERS: Alcon, Chapman, Handschuh, Hudson PRESENT ALTERNATES: Stallings PRESENT COUNCIL LIAISON: None

ABSENT MEMBERS: Adam, Teague ABSENT ALTERNATES: Furrie ABSENT COUNCIL LIAISON: None

ADMINISTRATIVE STAFF PRESENT: Glenna Batchelor, Director of Planning and Community Development Erik Smith, Assistant Director/Planning Projects Manager

ABSENCES

Commissioner Stallings, seconded by Commissioner Handschuh, moved to excuse the absences of Chair Adam and Commissioners Furrie and Teague. Motion passed unanimously.

APPROVAL OF MINUTES

Commissioner Stallings, seconded by Commissioner Handschuh, moved to approve April 9, 2019 Planning and Zoning Commission minutes. Motion passed unanimously.

PUBLIC HEARINGS AND ACTION ITEMS

Z-004-19

Application of Jennifer Trevino for a Zone Change request from “C-3” Commercial to “SF-1” Single-Family Residential on a tract of land situated in the Golden Gardens Addition, Lot 18, Block 3 and bring approximately .9182 acres north of Midway Road, locally known as 5613 Midway Road.

Staff presented and clarified the request.

The legal notice regarding the public hearing was published in the May 11, 2019 Fort Worth Star Telegram.

Written notice of the variance request was mailed to nineteen (19) property owners within 200' of the site on May 15, 2019. Staff received none (0) in favor or without objection, none (0) opposed, and none (0) returned to sender.

Acting Chair Chapman asked the applicant to come to the podium. Jennifer Trevino, 5613 Midway Road, Haltom City, Texas, 76117, advised that they are wanting to build a new larger residence and demolish the existing residence. She said her parents had lived there previously for over forty (40) years and they want to have a larger home for them to move in with her family so she can take care of them.

Acting Chair Chapman opened the Public Hearing (7:20PM) No one for or against. Acting Chair Chapman closed the Public Hearing (7:20PM) Discussion by the Commission None

ACTION BY THE COMMISSION Commissioner Stallings, seconded by Commissioner Handschuh, to approve the application of Jennifer Trevino for a Zone Change request from “C-3” Commercial to “SF-1” Single-Family Residential on a tract of land situated in the Golden Gardens Addition, Lot 18, Block 3 and bring approximately .9182 acres north of Midway Road, locally known as 5613 Midway Road.

Motion to approve the Zone Change passed 5-0-0.

 

CU-003-19

Application of Mark Miller for a Conditional Use Permit for contractor’s office (w/shop and garage) in the C-3 - Commercial District on a tract of land situated in the Fairview Acres Addition, Lot 10, Block 1 and being approximately .8484 acres north of Broadway Avenue, locally known as 4207 Broadway.

Staff presented and clarified the request.

The legal notice regarding the public hearing was published in the May 11, 2019 Fort Worth Star Telegram.

Written notice of the variance request was mailed to twenty (23) property owners within 200' of the site on May 15, 2019. Staff received two (2) in favor or without objection, one (1) opposed, and none (0) returned to sender.

Acting Chair Chapman asked the applicant to come to the podium. Mark Miller, 112 Amanda Lane, Springtown, Texas, said he purchased the property and was not aware the use was not allowed in the building. Mr. Miller said his main clients are multifamily properties and home flippers. Mr. Miller showed photos of what the inside of the building would look like (included in file).

Acting Chair Chapman asked about the surface for trailer parking.

Mr. Miller stated there is concrete through the gate to back area and crushed granite beyond that point.

Mrs. Alcon asked what would be stored outside.

Mr. Miller said trailers and company vehicles would be outside only. Materials would be stored inside warehouse area.

Acting Chair Chapman opened the Public Hearing to those desiring to speak (7:30 PM) No one for or against. Acting Chair Chapman closed the Public Hearing (7:30PM) Discussion by the Commission Ms. Batchelor suggested Commission consider no personal vehicles (i.e. boat/trailer, RV, etc.) be stored on property.

ACTION BY THE COMMISSION

Commissioner Handschuh, seconded by Commissioner Stallings, to approve the application of Mark Miller for a Conditional Use Permit for contractor’s office (w/shop and garage) in the C-3 - Commercial District on a tract of land situated in the Fairview Acres Addition, Lot 10, Block 1 and being approximately .8484 acres north of Broadway Avenue, locally known as 4207 Broadway with the stipulations that no personal vehicles be stored on site and proper maneuvering is in place.

Motion to approve the Conditional Use Permit passed 5-0-0.

 

STAFF UPDATE

Ms. Batchelor advised Commission that there will not be a meeting on June 11, 2019.
