PLANNING & ZONING COMMISSION

September 24, 2019

 

CALL TO ORDER Chair Adam called the meeting to order at 7:14PM

DETERMINATION OF QUORUM

PRESENT MEMBERS: Adam, Alcon, Beaty, Hantz, Ramsby, Teague PRESENT ALTERNATES: None PRESENT COUNCIL LIAISON: Hilliard

ADMINISTRATIVE STAFF PRESENT: Glenna Batchelor, Director of Planning and Community Development Erik Smith, Assistant Director/Planning Projects Manager Keith Fisher, Engineer

ABSENCES

Commissioner Ramsby, seconded by Commissioner Alcon, moved to excuse the absences of Commissioner Handschuh, Commissioner Lindgren and Commissioner Stallings. Motion passed unanimously.

APPROVAL OF MINUTES

Commissioner Alcon, seconded by Commissioner Teague, moved to approve September 10, 2019 Planning and Zoning Commission minutes. Motion passed unanimously.

 

PUBLIC HEARINGS AND ACTION ITEMS

P-012-19

Consider action on the application of Jesus Murillo for the Preliminary Plat of Lot 1, Block 1 of the Murillo Addition located in the “SF-2” Single Family Residential District, containing approximately 0.916 acres of land, locally known as 3048 Layton Avenue.

 

P-013-19

Consider action on the application of Jesus Murillo for the Final Plat of Lot 1, Block 1 of the Murillo Addition located in the “SF-2” Single Family Residential District, containing approximately 0.916 acres of land, locally known as 3048 Layton Avenue.

Staff presented and clarified the request.

The legal notice regarding the public hearing was published in the September 8, 2019 Fort Worth Star Written notice of the variance request was mailed to thirty-five (35) property owners within 200' of the site on September 13, 2019. Staff received two (2) in favor or without objection, none (0) opposed, and none (0) returned to sender.

Chair Adam asked the applicant to come to the podium. Carmelo Navarro/contractor, 1009 West Pafford Street, Fort Worth, Texas, 76110, said this will be a single-family home. Mr. Murillo lives across the street at 3047 Layton and wants a larger residence.

Samuel Montanez/builder, 301 Paradise Street, Fort Worth, Texas, 76111, said size of house will be 2200sf total with 1700sf air conditioned. One hundred percent (100%) brick and stucco.

Chair Adam opened the Public Hearing (7:20PM) No one in attendance. Chair Adam closed the Public Hearing (7:21PM) Discussion by the Commission No discussion.

ACTION BY THE COMMISSION

Commissioner Teague, seconded by Commissioner Alcon, moved to approve the application of Jesus Murillo for the Preliminary Plat of Lot 1, Block 1 of the Murillo Addition located in the “SF-2” Single Family Residential District, containing approximately 0.916 acres of land, locally known as 3048 Layton Avenue.

The motion passed unanimously.

Commissioner Teague, seconded by Commissioner Ramsby, moved to approve the application of Jesus Murillo for the Final Plat of Lot 1, Block 1 of the Murillo Addition located in the “SF-2” Single Family Residential District, containing approximately 0.916 acres of land, locally known as 3048 Layton Avenue with the following conditions:

  1. Place a five-foot (5') utility easement along the west property line on Lot 1.
  2. Update the date in the title block to October, 2019. This is when it will go to Council for approval.
  3. Parkland Dedication fee of $250 will need to be paid prior to signing of final plat.

The motion passed unanimously.

Application of Birdville I.S.D. for a Preliminary Plat of Lot 1, Block 1 of the Haltom Middle School Addition situated in the J.W. Elliston Survey, Abstract No. 472 and being a Preliminary replat of all Lots 1 thru 5, Block 1, Meadow Oaks West, containing approximately 16.809 acres of land, locally known as 5000 Hires Lane.

Application of Birdville I.S.D. for a Final Plat of Lot 1, Block 1 of the Haltom Middle School Addition situated in the J.W. Elliston Survey, Abstract No. 472 and being a Final replat of all Lots 1 thru 5, Block 1, Meadow Oaks West, containing approximately 16.809 acres of land, locally known as 5000 Hires Lane.

 

Staff presented and clarified the request.

The legal notice regarding the public hearing was published in the September 8, 2019 Fort Worth Star Telegram.

Written notice of the variance request was mailed to thirty-nine (39) property owners within 200' of the site on September 13, 2019. Staff received zero (0) in favor or without objection, one (1) opposed, and none (0) returned to sender.

Chair Adam asked the applicant to come to the podium. Tom Rutledge, Teague, Nall & Perkins, 5237 North Riverside Drive, Fort Worth, Texas, said they were going to build the school where the track currently is and then demo the existing school.

Commissioner Hantz asked if they were going to fix the drainage on Hadley. Keith Fisher said they were going to be installing a box culvert.

Commissioner Teague asked if this is a one- or two-story school. Mr. Rutledge said it is two story. Mr. Rutledge said this has been a year of pain with the logistical challenge and minor asbestos.

Commissioner Alcon asked about the timeline for construction.

Mr. Rutledge said it is out for bid at this time and they are looking to start in December or January and be ready for school year 2020-2021.

Commissioner Beaty asked about the construction site and protecting the students. Mr. Rutledge said the site would have construction fencing around the perimeter. Chair Adam opened the Public Hearing to those desiring to speak (7:29PM) Susan Cobb, 5055 Gaines Court, Haltom City, Texas, 76117, asked what impact Hadley asked have on Gaines Court.

Mr. Rutledge said there should not be any impact on Gaines Court.

Rex Kimberley, 3201 Owens, Haltom City, Texas, 76117, asked about street closure during construction.

Mr. Rutledge said Hires and Owens would not be blocked off to traffic. Hires and Owens would be open at all times.

Keith Fisher said there would be a project inspector from Public Works assigned to the project. Mr. Rutledge asked about the soccer field to the west of his property.

Mr. Rutledge said it may be used for parking and/or staging of material maybe. Chair Adam closed the Public Hearing (7:42PM) Discussion by the Commission No further discussion by the Commission.

Commissioner Teague, seconded by Commissioner Alcon, to approve the application of Birdville I.S.D. for a Preliminary Plat of Lot 1, Block 1 of the Haltom Middle School Addition situated in the J.W. Elliston Survey, Abstract No. 472 and being a Preliminary replat of all Lots 1 thru 5, Block 1, Meadow Oaks West, containing approximately 16.809 acres of land, locally known as 5000 Hires Lane.

The motion passed unanimously.

Commissioner Alcon, seconded by Commissioner Teague, to approve the application of Birdville I.S.D. for a Final Plat of Lot 1, Block 1 of the Haltom Middle School Addition situated in the J.W. Elliston Survey, Abstract No. 472 and being a Final replat of all Lots 1 thru 5, Block 1, Meadow Oaks West, containing approximately 16.809 acres of land, locally known as 5000 Hires Lane with the following conditions:

  1. Utility companies to sign off that there is nothing within the easement located on the east side of the property.
  2. Front yard setbacks are twenty-five feet (25') along all property lines having street frontages.

The motion passed unanimously.

 

STAFF UPDATE

Ms. Batchelor advised Commission that there will be a meeting October 8, 2019.
